Terms of Service

These terms apply to services provided by The Web HQ ("we", "us"). The full engagement terms for each project are set out in the written proposal you accept.

Proposals and scope

Every project starts with a written proposal that sets out the scope, price and timeline. Work outside that scope is quoted separately and agreed in writing before it begins.

Payment

Project work is billed 50% on acceptance of the proposal and 50% at launch, unless otherwise agreed. Care plans and SEO are billed monthly in advance. All prices are in Australian dollars.

Your responsibilities

You agree to provide content, feedback and approvals within the timeframes set out in the proposal, and confirm that you have the right to use any content, images and trademarks you supply.

Ownership

Shopify stores are built in a development store and handed over to your own Shopify account at launch. Websites are hosted and maintained by us on a platform suited to the site. Specific arrangements may differ depending on the site and its requirements.

Care plans

Every site we build is supported by a care plan from launch. Care plans run month to month with no fixed term. For websites we host, the plan includes the hosting, so if it is cancelled the site is taken offline once a handover or transfer has been arranged. Shopify stores are hosted by Shopify and stay live if a plan is cancelled. Included time is for the current month only and does not roll over.

SEO

Search engine rankings depend on factors outside our control. We do not guarantee specific rankings or traffic outcomes.

Liability

To the extent permitted by law, including the Australian Consumer Law, our liability for any claim relating to our services is limited to the fees paid for the services in question. Nothing in these terms excludes rights you have under the Australian Consumer Law.
